Josh is a construction specialist with experience in both non-contentious and contentious construction work.
Non-contentious
Josh works across several sectors including commercial, hotel, charity and student accommodation. Josh acts for developers, funders, joint ventures and consortiums on all aspects of construction projects from inception through to construction, completion and beyond. He has experience in drafting and advising on most forms of construction documentation including development agreements, forward funding contracts, building contracts, professional appointments, deeds of novation and deeds of collateral warranty. Josh takes a pragmatic approach in advising his clients and identifying the key commercial and legal issues that are relevant to their project.
Recent experience includes:
- the procurement of the construction package for Phase II and Phase III of the Battersea Power Station development;
- advising Tellon Capital on the construction aspects of several retail, office and residential schemes across the UK including the major re-development of the Bargate Quarter in Southampton;
- acting for a number of banks on the due diligence of construction packages for the development hotels across the UK;
- advising the Ennismore Hotel Group regarding construction works across their hotel portfolio in the UK and Europe;
- advising ABF on the negotiation of construction contracts and professional appointments throughout its UK and South East Asia region;
- advising British Sugar on the redevelopment of its former site in York.
Contentious
Josh has worked on a number of construction disputes and has experience of a wide variety of dispute resolution processes including adjudication, High Court litigation and mediation. He takes a pragmatic approach in advising his clients as to how to resolve disputes quickly and cost effectively as well as minimising the risk of disputes developing further.
Recent experience includes:
- acting for a Contractor regarding a PFI dispute at two hospital projects involving multi-party court proceedings;
- advising on the merits of a claim for an arbitration on defective products in the Middle East; and
- advising a major UK retailer in relation to delays of the refurbishment of it's UK headquarters and the resolution of the same.
