EXPERTISE 

Kate advises on Construction, Planning and Environmental law matters, both contentious and non-contentious.  Kate has advised developers and funders of construction projects and has experience reviewing and drafting Letters of Appointment and Collateral Warranties for design teams engaged on construction projects and preparing due diligence reports on construction matters.  Kate has also provided advice in respect of a High Court action regarding alleged building defects. 

Kate advises on planning and environmental law matters.  In this regard, Kate has provided extensive advice on exempted developments under Irish planning legislation and has assisted the Corporate Team with carrying out environmental due diligence. 

Experience
  • Several approved housing bodies and also with statutory bodies facilitating development finance for the construction of affordable housing including Tuath Housing, The Land Development Agency, Fold Housing Association and Home Building Finance Ireland. By way of example, Kate has provided advice in relation to the following projects:

Tuath Housing: the development of 40 social housing units in Tipperary.

The Land Development Agency: the development finance of affordable housing schemes on one of its first housing projects (Project Tosaigh) for 92 units being developed in Co. Waterford.

Fold: the purchase of 134 turnkey apartments in Dublin.

Home Building Finance Ireland: the development finance of 250 units being built in 3 phases in County Louth. 

CA Ventures on a 623-bed student accommodation development in Cork and a 250-unit development in Dublin to include the drafting and negotiating Letters of Appointment and Collateral Warranties to incorporate client and funder requirements. 

Advising a financial institution in relation to the development finance of several large housing developments with a high-profile developer. This work involved a review of design team appointments and warranties and sub-contractor's warranties. 

The re-development of a hotel in Dublin.
