Provider Selection Regime (PSR) Compliance Tool
Helping your business future proof its procurement strategy: be Provider Selection Regime (PSR) compliant
The new Provider Selection Regime (PSR / the Regime) came into force on 1 January 2024 and will radically change the way NHS bodies procure their public contracts. This is because the new Regime introduces 5 new routes to market, with only one of these being a competitive process and provides an opportunity for high-performing providers being reappointed in existing arrangements, without competition.
The Regime will apply to relevant healthcare services (with reference to a list of CPV codes) procured by NHS England, Integrated care boards, NHS trusts and foundation trusts, and Local authorities or combined authorities. The Public Contracts Regulations 2015 will no longer apply to these contracts. The new Procurement Act (which replaces the current Regulations and is expected to come in late 2024) will also not apply.
If you are a supplier to the relevant authorities for healthcare services, you need to ensure that you are well placed to be considered for new contracts, particularly in the four non-competitive routes to market. Your understanding of the Regime will help you navigate the system effectively and ensure compliance with the requirements.
Our PSR Compliance Tool is the first step for you to identify opportunities in the new landscape and to learn more about the new procurement procedures.
How the tool works:
1
Is your organisation
subject to the new rules?
The tool is designed for suppliers of healthcare services to relevant authorities, to help you understand what actions you need to take now to future proof your procurement strategy.
It asks a series of questions to help you establish whether your organisation may be subject to the Provider Selection Regime rules and, if so, which process under the Regime might be followed by the relevant authority to award a contract. We've also included some top tips / key considerations for you when you reach your result.
2
Option to complete the questionnaire
multiple times
You can complete the questionnaire as many times as you like if you have different contracts in mind, and you can also go back to the questions if you get a result you don't think is correct.
This questionnaire aims to analyse your company's obligations under the new Provider Selection Regime regulations which came into effect on 1 January 2024.
